Article 1-1: Application of the General Terms of Sales

These General Terms of Sales exclusively apply to business relations between, on the one hand, Pauline Fraisse, painter, professional with the Siret number 509 051 314 00052, located in Paris 75007, 7 rue Chevert, here after referred to as « Pauline Fraisse EI », and on the other hand, the persons wishing to buy a product or make a booking through the Website www.paulinefraisse.com here after referred to as « the client ».

The Website www.paulinefraisse.com can be used, on the one hand to buy products (works of art, objects), and on the other hand to book courses and workshops.

When making his order, the client acknowledges that he has read the General Terms of Sales by checking the box “I have read and accept General Terms of Sales”.

Article 1-2: The General Terms of Sales prevail over any other document

These General Terms of Sales are accessible at any time on this website, and prevail over any other version or any contradictory document. The fact that one of the parties does not call on a failure by the other party in complying with any one whatsoever of the obligations mentioned in the General Terms of Sales may not be construed as a waiver of the obligation in question.

Article 1-3: Free modification of the General Terms of Sales

According to our offer updates and to legal reforms, these General Terms of Sales can be modified. In that hypothesis, these modifications become applicable as soon as they are online, and can’t be applied to transactions concluded before.

Article 2: Contract

You state that you are at least 18 years old, and that you have legal capacity, or have parental consent allowing you to make an order or book on the Website.

Article 3: Making Orders and Bookings

The client can make an order or book online, from the online catalogue and calendar. The order or booking can be registered on the Website only if the client clearly identified themselves by typing in their client code (or specific ID number) and their password, that are strictly personal to them.

Any order or booking means acceptance of the price and description of the products or courses available for sale or booking.

Exceptional conditions in case of ordering unavailable products, or booking a course for which there are no more places available:

In case of an individual order for an article or a place in a course that is no longer available, the order is fully reimbursed.
In case of a multiple order, the unavailable articles are immediately reimbursed, and the remaining articles are delivered.
In case of a multiple booking, the unavailable course places are immediately reimbursed, and the booking confirmations for the remaining places are emailed.
Pauline Fraisse EI commits to inform the client by email as soon as possible.

During the French school holiday periods, the processing time can be extended as long as 5 to 40 days.

Article 4: Prices, availability and delivery

The prices displayed on www.paulinefraisse.com are in euros, all taxes included (VAT applied on the order’s day), except for shipping charges. These prices are suitable for the website only. Pauline Fraisse EI commits to fulfilling the orders received on the website only while product stocks last, and within the limits of available places for the courses and workshops ordered by the client.

In case the product or course ordered was unavailable, Pauline Fraisse EI commits to informing the client, by email or by telephone, as soon as possible. We reserve the right to offer you as a replacement an article or a course of equivalent quality and prices; in case you wouldn’t like this article of equivalent quality and prices, you can cancel your order.

Article 4-1: Shipping charges: Prices

In case of works of art and products, the client can have his order delivered (see prices in article 4-1-1), or come to the studio with an ID card and his order number to fetch his order. In case of picking up an order at the studio, the client must wait for the confirmation email before coming to the studio to pick up his order. Collecting orders is done by appointment.

Some artworks can’t be mailed. In that case, the client contacts Pauline Fraisse EI to organize the fetching of his order, or to ask for a quotation regarding delivery fees.

The client is informed of the mail shipping possibilities in the Description of each artwork. In case this information was exceptionally missing in the Description, the client is invited to contact Pauline Fraisse EI to check on the information.

Article 4-1-1: Prices for orders collected at the studio

In case of picking up an order directly at the studio, the shipping charges are free. Pauline Fraisse EI’s address is:

Article 4-1-2: Prices for orders delivered upon quotation request

In the case of works or products that can’t be delivered by mail (size, fragility…), the client checks “picking up at the studio” when ordering. He contacts Pauline Fraisse EI to request a quotation for packaging and shipping fees.

Article 4-1-3: Prices for « Colissimo Suivi » mail service

The parcels that can be sent by mail are sent by the French postal service « Colissimo ». A follow-up number is sent when shipping the parcel. The shipping charges are based on the article weight, including the packaging: For metropolitan France:

Article 5: Terms of Payment

Article 5-1: Payment by credit card

The client can pay by credit card (Carte Bleue, Visa, Eurocard Mastercard). The payment by credit card is done on the secure servers of our partner BNP Paribas Axepta (BNP Paribas), none of your bank information ever transits through www.paulinefraisse.com. Your order or booking is registered and confirmed once the BNP Paribas services accepted the payment.

Article 5-1-1: Delivery Address Confirmation

In order to avoid any credit card fraud, we ask the clients, for expensive orders, to provide a proof of address (official electricity or phone invoice with the same delivery address as on the website order).

Article 5-2: Payment by Paypal

The client can pay on the secured website Paypal, we only accept Verified Paypal accounts.

The fees charged by Paypal are payable by the client. When paying an order with Paypal, the price of the product or course is increased by 5%, in order to cover the Paypal charge. Paypal charges an average 5% fee that varies according to the transaction’s country of origin.

Article 5-2-1: Delivery Address Confirmation

In order to avoid any fraud or spoofing of your Paypal account, we ask the clients, for expensive orders, to provide a proof of address (official electricity or phone invoice with the same delivery address as on the website order).

Article 5-3: Payment by check

The client can pay by check, provided that the check is in euros, from a French bank. The check, duly completed, is payable to Pauline Fraisse EI, and sent to the address here below:

The payment by check doesn’t guarantee the instant booking of a course or product. The booking is confirmed to the client upon receiving the check, and subject to availability of the course or product when the check is received.

Article 6: Right to withdraw and Conditions for cancellation

Article 6-1: Cancellation of a booking for a course or workshop

Any booking for a course or workshop is definitive.

In case the client doesn’t show up to the course, or arrives too late to be able to meet up with the group, the booking fees are not reimbursed.
In case the client wishes to cancel their participation to a course or workshop that they had booked, up to ten (10) days before the date of the course or workshop, 50% of the booking fees are reimbursed. This amount equivalent to 50% of the paid fees is credited with the same means of payment that was used for the booking.
In case the client cancels during the ten (10) days preceding the date of the course or workshop, the booking fees are not reimbursed.
The potential reimbursement expenses charged by the bank or by Paypal are payable par the client.
In case of cancellation of a course of workshop by Pauline Fraisse EI, the booking fees are fully reimbursed to the client, and credited with the same means of payment that was used for the booking.
In case of rain, the courses and workshops planned outdoors are not canceled. We work at a café or in a sheltered place.

Article 6-2: Right to withdraw following the purchase of a work of art or a product

When buying a work of art or a product (pass for several classes, art supplies, book, postcards…), the client has fourteen (14) days to exercise his right to withdraw. The fourteen (14) days time period starts from the date of reception of the ordered articles. This right to withdraw is excluded when the delivered products have obviously been used. The ordered articles must necessarily be returned in their original packaging, in a perfect state for resale (not damaged, soiled or destroyed by the client), with all their possible accessories, instruction sheets and documentation, and with the invoice, to the address here below.

The return shipping charges are payable by the client. No cash-on-delivery returns will be accepted. Upon receiving the articles, or the client’s sending proof, the amount reimbursed will be sent by email to the client, and credited with the same means of payment that was used for the order.

Article 6-3: Return against exchange of size, color or product

For returns that concern exchanges of size, color or model, the client is encouraged to contact Pauline Fraisse EI by email or through the contact sheet of the Website www.paulinefraisse.com, for instructions regarding returns (authorization request and procedure).

The opening times for phone calls are from Monday to Friday, from 9:30AM to 6:00PM, Paris time. The return shipping charges are payable by the client. No cash-on-delivery returns will be accepted.
In case of mistake on our part, a return voucher will be mailed by post to you, you will glue it on the return parcel.

Article 7: Guarantee

The Client benefits from the legal guarantee of hidden defects in products, in articles 1641 and subsequent articles of the French Code Civil, and from the legal guarantee of conformity provided in the articles L211-1 and subsequent articles of the French Code de la Consommation.

Article 8: Liability

Pauline Fraisse EI and the client agree on defining the main characteristics of the commercialized courses, workshops or articles as those publicly displayed on the website www.paulinefraisse.com, except for the photographs and texts reproduced that are not contractual and are supplied for information purposes only. Consequently, Pauline Fraisse EI is bound by no obligation regarding the conformity of the commercialized products, courses or workshops to the photographs or texts reproduced.

Article 8-1: Liability concerning the use of products

Pauline Fraisse EI should in no way be held responsible for the damages of any kind to property or to persons, that could result from an abnormal use, or from a use in non reasonably predictable conditions, of the articles sold on the Website.

Article 8-2: Liability concerning taking part in courses and workshops

The client certifies that he subscribed an insurance policy, and takes full liability for the damages of any kind to property or to persons, that could result from his negligence during a course or workshop.

Article 8-2-1: Children and Teenagers under 18 years old

For security reasons, Pauline Fraisse EI doesn’t accept children under 18 years old in courses taking place out on the street or at the Louvre, unless they are accompanied by a parent, grandparent or guardian. This person must join the course as well (paying the same fee as the other students). When accompanied by a parent, grandparent or guardian, children and teenagers can join any workshop, or take adult customized classes. Otherwise, classes for children and teenagers take place at the studio (7, rue Chevert 75007 Paris). Pauline Fraisse EI should in no way be held responsible for the damages of any kind to property or to persons that could result from the student’s negligence during a course or workshop.

Article 8-2-2: Supplies

In adult classes and workshops, the supplies needed for the course are not provided. Each participant brings their own supplies. The client certifies that he looked at the list of supplies that was provided to him, in the course description on the Website www.paulinefraisse.com, and in the list that was sent to him upon booking. The client can also look at the FAQ on the Website www.paulinefraisse.com.

Article 8-2-3: Respect of course organization

The number of participants in a course is limited to 6 or 8 persons, depending on the courses.

Out of consideration for the other students, accompanying persons are not authorized to follow the course, unless they registered as well.

Article 9: Case of absolute necessity

Pauline Fraisse EI should in no way be held responsible for any breach of her contractual obligations in the occurrence of a case of absolute necessity or fortuitous event, including but not limited to that, epidemics, natural disasters, fires, internal or external strikes, internal or external failures or breakdowns, and generally speaking any event preventing from good transmission and/or fulfillment of an order or booking.

Article 10: Applicable law and competent courts

The present contract is submitted to the French law. The contract language is French. In case of difficulty related to the interpretation or to the application of this contract, the parties will do their best to settle their dispute out of court. In case of failure of these attempts, any contestation will be brought before the courts indicated as competent by the legal requirements in force at the moment of the court referral.
